These Terms of Service ("Terms") govern your use of our website and services provided by ztechprovexis d.o.o., a company registered in Croatia with registration number 963257418, located at Masarykova ulica 117, 21530 Split, Split-Dalmatia, Croatia ("Company", "we", "our", or "us").

ztechprovexis provides enterprise data analytics stack implementation services, including but not limited to:

• ETL pipeline development and deployment
• Analytics platform integration
• Data governance and security implementation
• Training and knowledge transfer services
• Ongoing support and maintenance

Specific services, deliverables, timelines, and pricing are detailed in separate service agreements or statements of work executed between ztechprovexis and the client.

User Obligations

When using our services or website, you agree to:

• Provide accurate and complete information when requested
• Use our services only for lawful purposes and in accordance with these Terms
• Not interfere with or disrupt the operation of our website or services
• Not attempt to gain unauthorised access to any part of our systems

• Late payments may incur additional charges
• All prices are exclusive of applicable taxes unless stated otherwise
• Refunds are subject to the terms of individual service agreements

Limitation of Liability

To the maximum extent permitted by applicable law, ztechprovexis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services
• Any unauthorised access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, trojan horses, or the like that may be transmitted by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

Our total liability to you for all claims arising from or related to these Terms or our services shall not exceed the total amount paid by you to ztechprovexis in the twelve months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless ztechprovexis, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Split, Croatia, and you hereby consent to personal jurisdiction and venue therein.

Dispute Resolution

Before initiating any formal legal proceedings, the parties agree to attempt to resolve any disputes arising from these Terms through good faith negotiations. If such negotiations fail, disputes shall be resolved through the appropriate courts in Split, Croatia.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use our services will cease immediately.

You may terminate your use of our services at any time by discontinuing use of our website and services. Termination of these Terms will not affect any rights or obligations that have accrued prior to termination.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.

Force Majeure

ztechprovexis shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, pandemic, governmental action, war, terrorism, or other causes beyond our reasonable control.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on our website, constitute the entire agreement between you and ztechprovexis concerning your use of our website and services, superseding any prior agreements between you and us regarding the same subject matter.

Modifications

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on our website and updating the "last updated" date. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
